These Terms and Conditions (“Agreement”) govern the Membership, Programs, Courses or any other services offered by Growthyfai Technologies Private Limited (“Company”), operating under the brand name “Growthyfai.” By enrolling in the Any Membership, Programs, Courses or any other services offered by Growthyfai, you agree to these terms and conditions, which are legally binding. If you disagree with any part of these terms, do not proceed with the purchase.
1. Non-Refundable Policy
1.1. No Refunds: Fees paid for the Diamond Membership are strictly non-refundable under any circumstances, including but not limited to:
- Health, financial, or professional reasons.
- Failure to attend or participate in the sessions.
- Changes in the program structure, schedule, or trainer.
- Personal reasons (e.g., dissatisfaction with the program, unmet expectations, change of mind).
1.2. Refunds for Other Programs:
- A 3-day refund policy applies to the AI Champions Program (Silver Membership) starting from when access is granted by Growthyfai.
- Any refunds for other services, if applicable, will be issued solely at the discretion of Growthyfai in the form of credits for other services offered by the Company.
2. No Guarantee of Income, Growth, or Outcomes
2.1. Disclaimer of Results: The Diamond Membership provides learning and developmental resources, but the Company does not guarantee any specific outcomes, including income growth, career advancement, business success, or personal development.
2.2. Implementation Risks: You agree that any outcomes resulting from the learning or implementation of strategies taught during the program are your sole responsibility.
3. Subscription of Services
3.1. Service Description: Growthyfai offers various educational services, including but not limited to pre-recorded courses, live training sessions, hackathons, and cohort-based programs.
3.2. Access Rights: Subscription to a service provides limited, non-transferable access to the specific content of that service. Access does not extend to additional services or future content unless explicitly stated.
3.3. Service Validity: Each subscription is valid for the Announced duration which is mentioned at the time of enrollment of that particular program. Renewal requires payment of the applicable subscription fees. 12 Months Access for Diamond Membership & Silver memberships as on Dec 05, 2024
3.4. Service Modifications: We reserve the right to modify, add, or remove content or features of the services at any time without prior notice.
4. Program Flexibility
4.1. Session and Trainer Adjustments:
- The timing and schedule of live sessions, hackathons, and other activities may change at the discretion of the Company.
- Trainers may also change without prior notice.
4.2. Modification of Curriculum: The Company reserves the right to modify, adapt, or alter the curriculum, structure, and content of the program without prior notice or obligation.
5. Legal and Jurisdictional Terms
5.1. Dispute Resolution: Before initiating any legal proceedings, you agree to notify the Company of any issues or grievances and allow a reasonable opportunity for resolution.
5.2. Jurisdiction: All disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts in Maharashtra, India.
5.3. No Legal Claims:
- You agree not to file any legal claims or complaints against the Company without prior consultation and an attempt to resolve the issue.
- The Company is not liable for any unintended side effects or consequences arising from the use of the knowledge, resources, or tools provided in the membership.
6. Acknowledgment of Obligations
6.1. No Obligation to Refund: You acknowledge that the Company is under no obligation to refund fees or charges for:
- Your failure to attend or participate.
- Modifications or extensions of the program.
- Changes in the program commencement date, structure, or content.
6.2. Refund Discretion: Any refund, if considered, will be provided solely at the discretion of the Company and may be issued as credits for other services.
7. Indemnity
You agree to indemnify and hold harmless Growthyfai Technologies Private Limited, its employees, affiliates, and agents, from any claims, damages, or liabilities arising from your participation in the program or use of its resources.
8. Binding Agreement
By purchasing the Diamond Membership, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions.
