These Terms and Conditions (“Terms”) govern the use of the services and products offered by Growthyfai Technologies Private Limited, operating under the brand name Growthyfai (“we,” “our,” or “us”). By accessing, viewing, or using the services on www.growthyfai.com (“Website”) or any related platform, you agree to comply with and be bound by these Terms. If you do not agree, please refrain from using our services or accessing our Website.
1. Introduction
1.1. These Terms constitute a legally binding agreement between Growthyfai Technologies Private Limited and you (the “User”).
1.2. By accessing, registering, or using our Website and services, you confirm that you are of legal age to form a binding contract, or you are accessing with parental or guardian consent.
1.3. These Terms incorporate our Privacy Policy, and additional terms may apply to specific services.
2. Subscription of Services
2.1. Service Description: Growthyfai offers various educational services, including but not limited to pre-recorded courses, live training sessions, hackathons, and cohort-based programs.
2.2. Access Rights: Subscription to a service provides limited, non-transferable access to the specific content of that service. Access does not extend to additional services or future content unless explicitly stated.
2.3. Service Validity: Each subscription is valid for the Announced duration which is mentioned at the time of enrollment of that particular program. Renewal requires payment of the applicable subscription fees.
2.4. Service Modifications: We reserve the right to modify, add, or remove content or features of the services at any time without prior notice.
3. Registration of Users
3.1. Users must register by providing accurate, complete, and current information.
3.2. Users agree to maintain confidentiality of their login credentials and are responsible for all activity under their account.
Prohibited Actions:
- Sharing credentials with third parties for any reason, especially commercial purposes.
- Impersonating another person or providing false information.
- Engaging in unauthorized use of the platform for hacking, spamming, or damaging the services.
4. Pricing and Payment
4.1. Fee Structure: All fees must be paid in full and in advance. Services may be suspended or terminated for incomplete payments.
4.2. Third-Party Payment Gateways: Payments are processed through independent service providers. Growthyfai is not liable for any issues arising from third-party platforms.
5. Refund Policy
5.1. AI Champions Program: A refund is available for the AI Champions Program (Silver Membership) within 3 days of access being granted if the following conditions are met:
You give us the reasons and evidence for refund other than personal or financial ones (for instance, the content was defective or completely inaccurate, etc.) as explained below.
You have followed the learning curriculum at least 3 consecutive days within the first 3 days after the purchase, and
5.2. Diamond Membership: Fees for the Diamond Membership are strictly non-refundable under any circumstances, including:
- Personal dissatisfaction or unmet expectations.
- Health, financial, or professional reasons.
- Modifications or changes in the service structure or schedule.
- Changes in the program structure, schedule, or trainer.
5.3. Refunds Discretion: Any refund, if provided, will be at the sole discretion of Growthyfai and may be issued as credits for other services.
5.4. No Guarantee of Income, Growth, or Outcomes, Disclaimer of Results: Any of our program provides learning and developmental resources, but the Company does not guarantee any specific outcomes, including income growth, career advancement, business success, or personal development.
5.5. Implementation Risks: You agree that any outcomes resulting from the learning or implementation of strategies taught during the program are your sole responsibility.
6. Program Flexibility
6.1. Session and Trainer Adjustments:
- The timing and schedule of live sessions, hackathons, and other activities may change at the discretion of the Company.
- Trainers may also change without prior notice.
6.2. Modification of Curriculum: The Company reserves the right to modify, adapt, or alter the curriculum, structure, and content of the program without prior notice or obligation.
7. Membership Duration and Renewal
7.1. 12-Month Access: Membership benefits, including live sessions, hackathons, and other activities, are available for 12 months from the date of the welcome session or program commencement.
7.2. Renewal: After 12 months, continued LIVE Sessions access requires payment of the applicable subscription fee for next cycle of program
8. Legal and Jurisdictional Terms
8.1 Dispute Resolution: Before initiating any legal proceedings, you agree to notify the Company of any issues or grievances and allow a reasonable opportunity for resolution.
8.2 Jurisdiction: All disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts in Maharashtra, India.
No Legal Claims:
- You agree not to file any legal claims or complaints against the Company without prior consultation and an attempt to resolve the issue.
- The Company is not liable for any unintended side effects or consequences arising from the use of the knowledge, resources, or tools provided in the membership.
9. Acknowledgment of Obligations
9.1. No Obligation to Refund: You acknowledge that the Company is under no obligation to refund fees or charges for:
- Your failure to attend or participate.
- Modifications or extensions of the program.
- Changes in the program commencement date, structure, or content.
9.2. Refund Discretion: Any refund, if considered, will be provided solely at the discretion of the Company and may be issued as credits for other services.
10. Indemnity
You agree to indemnify and hold harmless Growthyfai Technologies Private Limited, its employees, affiliates, and agents, from any claims, damages, or liabilities arising from your participation in the program or use of its resources.
11. Binding Agreement
By purchasing the Diamond Membership, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions.
12. User Conduct
Users must maintain decorum and integrity while using our Website and services. Prohibited behaviors include, but are not limited to:
- Distributing harmful, illegal, or offensive content.
- Engaging in harassment, defamation, or hate speech.
- Tampering with or attempting unauthorized access to our systems.
- Sharing false information or impersonating others.
13. Intellectual Property Rights
13.1. All content on the Website and services, including but not limited to text, videos, graphics, and software, is the exclusive property of Growthyfai or its licensors.
13.2. Users are granted a non-exclusive, non-transferable license to use the content for personal, non-commercial purposes.
13.3. Users must not:
- Reproduce, distribute, or exploit any content for commercial gain.
- Modify, alter, or reverse engineer any software or technology provided.
14. Limitation of Liability
14.1. Growthyfai is not liable for:
- Indirect, incidental, or consequential damages arising from the use of our services.
- Inability to meet individual expectations or outcomes, including income, career growth, or business success.
- Disruptions caused by factors beyond our control, including force majeure.
14.2. Users agree that any learning outcomes or implementation of content provided are solely their responsibility.
15. Dispute Resolution and Jurisdiction
15.1. Prior Consultation: Users must notify Growthyfai of any grievances and allow an opportunity for resolution before initiating legal action.
15.2. Jurisdiction: All disputes shall be governed by the laws of India, with exclusive jurisdiction vested in the courts of Maharashtra.
15.3. No Legal Action Without Discussion: Users waive their right to initiate legal proceedings without prior consultation and resolution attempts.
16. Termination of Services
16.1. Growthyfai reserves the right to terminate or suspend accounts for violations of these Terms.
16.2. Fees already paid will remain non-refundable in cases of termination.
17. Modification of Terms
17.1. Growthyfai may update these Terms at any time, with notice provided through the Website or email.
17.2. Continued use of the services after updates constitutes acceptance of the modified Terms.
